Make sure if you pursue any of the above options that the work is clearly marked "not for hire" so that you retain full rights to the work. And if you are going to do SaaS, you want to make sure they don't have the right to compete with you using your code.

comment equity max of 23% split among “development” — a ripoff?
Can they dilute your equity position? Do they have the right to issue additional shares? If so you could end up with considerably less than 23% in the long run.

Probably needs to be said here that 9 women don't make a baby in 1 month. Sometimes finding and recruiting good technical talent is hard. You can find people with credentials, but not necessarily the mojo you need. I had to dismissa CS guy with a Masters Degree because he just couldn't deliver usable code. If you have the money to go poaching for employees, they need to know that, and probably need a recruiting firm to go looking for them, bringing in candidates. Building a team takes time, and building a good team takes even longer.

comment Is SaaS really a profitable market now (compared to 2005)?
Salesforce charges in excess of $200/month for some of their offerings, so I don't feel this set of numbers is any more arbitrary than the other.

As a seller, I would be more inclined to go with the $10 after the first sale, but I question what do I get for my $10. You are already getting 3%

Contests may be how they are doing it, but it is difficult to see there being sufficient revenue in them to pay for 24 staff members.....

So far they seem to be touting that they are "free" and it seems as if they plan on staying that way though. The mailing list is a possibility but I can find no mention of any I can sign up for, and all the notifications they will alert you to are for stories that are posted, comments etc....

Contact the people @ Bodyrock.tv, they are having people post things on facebook and the comments of their website. Sounds almost like a match made in heaven.

With the caveat, how will you deal with termination if things don't work out. Families can make good business partners. In all of my experience, things go great that the beginning, and then go sour. At the end of sour you no longer have a family. I lost my family a little over 6 years ago because they preferred my sister and her husband over me, even though he did practically nothing, and I created all the software. I will never go into business with my kids because of this. They are the only family I have left.

You will not be able to fire them without a backlash. That isn't a maybe, its a given.
