We're a startup company, seed funded, post users, pre revenue. We want to hire a H1B visa employee currently at another company in the US. meets all the requirements of a special occupation. any advice on what we need in the bank to get approved as an H1B sponsor?

Peter, My advice, after all legal fees and USCIS hell you are better off either outsourcing or hiring a non-visa candidate. H1b in post 9/11 era is a big boys game. It requires so much documentation and so much compliance work. And considering you are legally required to pay prevailing wage, why would you pay extra costs of H1B?

Agreeing on the costs and overhead - my day job company did an evaluation a couple of years ago and came to the same conclusion. You should also look into whether you can get a tax break for "creating American jobs". I doubt this would apply for one or two hires, but given the current political climate... – Seenu Apr 13 '10 at 19:13
